Article 1 Overview of the Service

1. The “X Caliber Vet AI Service (AI-based Veterinary Imaging Diagnostic Assistant Service)” (hereinafter referred to as the “Service”) is a service that analyzes veterinary images and provides members with indicators for reference through a PDF Report. It serves as a tool to assist members with their diagnosis; however, the ultimate responsibility for the judgment, diagnosis and treatment of veterinary images rests with the treating member.
2. The details of the service provided, usage fees for the paid service, and individual limits for free trials may be subject to change based on the circumstances of Prolotus Australia Pty Ltd T/A ATX Medical Solutions (hereinafter referred to as the “Company”). Any changes will be announced on the ATX Website.

Article 2 Other Applicable Rules

Matters not specified in these Terms and Conditions shall be governed by the Terms of Use or specific guidelines available on the Website. In particular, please refer to the content of the Terms of Use of the X Caliber Platform on the Website for information about usage fees.

Article 3 Utilization of Data for Improving Service Quality

1. The Company may use the images uploaded by members to the Service to improve the quality of the Service.
2. The usage history and method of the images used will be notified through the notice section on the Website, and all data will be deleted upon the member’s termination of the service contract (membership withdrawal).

Article 4 Compliance/Restrictions/Disclaimer

1. Members are not allowed to provide or sell the data related to the Service to others without the Company’s prior consent. Violation of this Article will result in suspension of usage of the Service.
2. The Service can be used by one user, and up to three (3) simultaneous users are permitted solely for the purpose of providing treatment and diagnosis information to guardians within animal hospitals. To use the Service for any other purpose, multiple users must subscribe to the Service separately. Failure to comply with this Article will be considered a violation of the contract.
3. To identify members who violate these Terms, the Company may monitor the usage status of the Service and suspend the Service for members found to be in violation of this agreement.
4. Members wishing to exceed the individual free trial limit must subscribe to the paid service in order to continue using the Service. If members violate this Article, such as using the free trial in an unauthorized manner, the Company may suspend the Service for that member.
5. Members are prohibited from making any misleading, deceptive, or disparaging statements regarding the performance or quality of the Service in comparison with the services of third parties. In the event a Member breaches this provision, the Company reserves the right to, at its sole discretion, terminate or suspend the Member’s access to the Service.
6. The Company provides members with the AI-based Veterinary Imaging Diagnostic Assistant Service, but it shall not be responsible for any contracts entered into between the members and medical equipment companies.
7. The Company assumes no responsibility or liability for any errors or omissions in the content of the reports. The information contained in the reports is provided on an “as is” basis with no guarantees of completeness, accuracy, usefulness or timeliness.
