Terms and Conditions of Sale
ATX Medical Solutions Pty Ltd ABN 42 693 566 175 (“ATX”) offers to sell Goods on the following terms and conditions (“Terms”).

1. Interpretation
In these Terms:
(a) “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth);
(b) “Business Day” means a day on which banks are open for business in Sydney, NSW, excluding Saturdays, Sundays and public holidays;
(c) “Goods” means any consumables, accessories or other products supplied by ATX;
(d) “Order” means an order placed by the Purchaser to purchase Goods from ATX, whether through the Website or otherwise;
(e) “Purchaser” means the person or entity purchasing the Goods; and
(f) “Website” means atx.com.au and any related ATX online portals.
Nothing in these Terms will be read or applied so as to exclude, restrict or modify any condition, warranty, guarantee, right or remedy implied by law (including the Competition and Consumer Act 2010 (Cth)) which by law cannot be excluded, restricted or modified.
2. General
2.1 All Goods sold by ATX are sold subject to these Terms, which prevail over any terms or conditions of the Purchaser’s order to the extent of any inconsistency.
2.2 ATX may update these Terms at any time by publishing a revised version on the Website. The “Last updated” date above indicates when the latest changes were made. Placing an Order after an update constitutes acceptance of the then-current Terms.
2.3 These Terms may only be waived or amended in writing signed by ATX.
3. Online Orders
3.1 Pricing for Goods is listed on the Website. No separate quotation is required for Website purchases.
3.2 To place an Order through the Website, the Purchaser must create an account and provide accurate information including name or company name, contact number, email address and delivery address. This information is handled in accordance with ATX’s Privacy Policy.
3.3 Before submitting an Order, the Purchaser must confirm they have read and agree to these Terms and, where purchasing on behalf of a company, that they have authority to do so.
3.4 ATX reserves the right to decline or cancel any Order at its discretion, including in cases of pricing errors, stock unavailability or suspected fraudulent activity.
3.5 The Purchaser is responsible for ensuring that any persons with access to their account are authorised to make purchases. ATX accepts no responsibility for transactions made by unauthorised users.
4. Prices
4.1 All prices are in Australian dollars (AUD) and are inclusive of GST unless otherwise stated.
4.2 Prices on the Website are subject to change without notice.
4.3 Delivery charges are additional and will be shown at checkout.
5. Payment
5.1 Full payment for Website Orders must be received before Goods are dispatched.
5.2 Payment is accepted via the methods available at checkout. Some payment methods may attract additional fees, which will be disclosed prior to completing your Order.
5.3 An order confirmation and receipt will be sent to the Purchaser’s nominated email address once payment has been processed.
6. Delivery
6.1 ATX delivers to addresses within Australia only.
6.2 Goods are at the Purchaser’s risk from the time of delivery. ATX recommends the Purchaser arrange appropriate insurance cover after delivery.
6.3 Delivery timeframes provided are estimates only. ATX is not liable for delays caused by third-party carriers or circumstances beyond our reasonable control.
6.4 If the Purchaser disputes proof of delivery, written notice must be provided to ATX within seven (7) Business Days of the expected delivery date.
7. Backorders
7.1 Some products may be available for order while temporarily out of stock. Where a product is on backorder, this will be indicated on the product page.
7.2 By placing an Order for a backordered item, the Purchaser acknowledges that dispatch will occur once stock becomes available. ATX will provide an estimated delivery timeframe where possible.
8. Returns and Refunds
8.1 The Purchaser must inspect Goods as soon as practicable after delivery.
8.2 Returns may be requested within ten (10) days of receiving the Goods, subject to the following conditions:
- The item must be unused, in its original packaging and in resaleable condition.
- Proof of purchase must be provided.
- Consumable items that have been opened or used are not eligible for return, unless the item is faulty or incorrectly supplied.
- Return shipping costs are the responsibility of the Purchaser unless the item is faulty or incorrectly supplied.
8.3 Approved returns are subject to a restocking fee of 15% of the invoiced value of the returned Goods.
8.4 To initiate a return, please contact ATX at orders@atx.com.au with your order number and reason for return. Returns will not be accepted without prior written approval from ATX.
8.5 Once the returned Goods have been received and inspected, ATX will notify the Purchaser of the outcome. Approved refunds will be processed to the original payment method within five (5) to seven (7) Business Days.
9. Faulty or Incorrect Items
9.1 If the Purchaser receives a faulty, damaged or incorrect item, written notice must be provided to ATX within seven (7) Business Days of delivery, including the order number and a description of the issue.
9.2 ATX will arrange a replacement or full refund at no cost to the Purchaser, including return shipping where applicable, upon verification of the claim.
10. Order Cancellation
Orders cannot be cancelled or deferred without the prior written consent of ATX. ATX reserves the right to charge reasonable cancellation fees where an Order has already been processed or dispatched.
11. Warranties
11.1 ATX warrants that all Goods sold will conform to the relevant manufacturer’s specifications.
11.2 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
12. Limitation of Liability
12.1 To the maximum extent permitted by law, ATX’s liability for any claim arising from a Website purchase is limited to one of the following, at ATX’s option: replacement of the Goods, supply of equivalent Goods, repair of the Goods, or payment of the cost of replacement or repair.
12.2 ATX is not liable for any indirect, incidental or consequential loss or damage, except where required under the Australian Consumer Law.
13. Privacy
13.1 Personal information collected through the Website is handled in accordance with ATX’s Privacy Policy, available at atx.com.au/privacy-policy.
13.2 ATX’s online payment portal uses secure encryption technology. No payment details are stored in ATX’s database.
13.3 ATX will not provide the Purchaser’s personal information to third parties without prior written consent, except as required by law.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales. These Terms are also subject to applicable Australian legislation including the Competition and Consumer Act 2010 (Cth) and the Privacy Act 1988 (Cth), as amended from time to time.
15. Severance
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining Terms will continue in full force and effect.
